1. General

The music recordings by Music Nomads are published on various labels. At our discretion, we will make the recordings available to music users free of charge to select music, but the recordings remain our property.

2. TV productions

For TV productions and TV service productions by the stations that have a valid contract with GEMA, there are no costs or fees if the broadcast is in an EU country or in Switzerland (TV except advertising). However, the client is obliged to notify GEMA and GVL about the usage of the music tracks, following GEMA’s and GVL’s guidelines and requirements. By submitting these lists, we are deemed to have given permission to use our music recordings.

3. Third party licensing

Clients who shared our music recordings with third parties (agencies, recording studios, productions, etc.) and wish that our invoice goes directly to the client are obliged to notify us by copy of the recordings given to a third party and the client about our terms and conditions.

4. Placing an order (Advertising and Film synchronization)

If recordings are requested from us that are to be used commercially or privately in film or advertising (or other usage not covered by the GEMA contract), an order has to be placed with us. With the use of our music recordings, the client already accepts the currently valid price list. The client is obliged to provide us with precise information about the use of music at the latest two weeks after completion of the production. The license application must contain all the necessary information..

5. Prices and terms of payment

Our price list valid on the day the order is placed is decisive. We calculate the exploitation rights based on the notification sent to us (license application). Unless otherwise agreed, the invoice is to be paid net 14 days after receipt of the invoice, plus the applicable sales tax if applicable.

6. Warranty and retention of title

Any use or use of our music recordings (or parts thereof) without notification of use or usage to us is prohibited (applying to usage outside GEMA contract). For every use of music that goes beyond the scope of the license applied for or that takes place without the granting of a legal authorization, at least double the license fee is due as a contractual penalty, which is otherwise calculated on the basis of the valid price list for the contractual use. Rights to be granted by us are only considered granted after payment of our invoice (reservation of title). For properly acquired usage rights from us, we provide the music user with all claims by third parties (musicians, producers, etc.). free. This does not apply to the claims of copyright collecting societies (e.g. GEMA).

7. Copyrights

The performance rights and the right for the mechanical reproduction of the compositions produced in our recordings are exercised by GEMA (Society for Musical Performance and Mechanical Reproduction Rights, Berlin and Munich). These rights are to be obtained from the music consumer at GEMA.

8. Ineffective provisions

The ineffectiveness of individual provisions of this contract or its components does not affect the effectiveness of the other regulations. The contracting parties are obliged in good faith to replace an ineffective provision with an effective regulation that is equivalent to their economic success, provided that this does not result in a significant change to the content of the contract; the same applies if a matter requiring regulation is not expressly regulated.

9. Place of performance and jurisdiction

The place of performance is the headquarters of Music Nomads. The place of jurisdiction is for the company headquarters of

Music Nomads competent place of jurisdiction, insofar as the customer is a businessman. Music Nomads is also entitled to sue in a court that is responsible for the customer's registered office or branch.
